Plain summary

1. gamedai is an iOS app and website for interactive NFL audio, fantasy context, and football questions.
2. You need an account for the app. Keep your account information accurate, use one account, and do not abuse the service.
3. Premium is $9.99 per month with a 7-day free trial. Lifetime is a $99.99 one-time purchase. Purchases are billed by Apple.
4. gamedai commentary and Scout answers can be generated by automated systems and may be wrong. They are informational only, not betting, wagering, financial, or professional advice.
5. gamedai is not affiliated with or endorsed by the NFL, any NFL team, or any fantasy platform unless we say so in writing.

Agreement to these terms

These Terms govern your use of gamedai, including the gamedai iOS app, gamedai.app, and related support, account, subscription, and content features.

By using gamedai, creating an account, starting a trial, buying a subscription, buying Lifetime unlock, or using gamedai.app, you agree to these Terms. If you do not agree, do not use gamedai.

"gamedai," "we," "us," and "our" mean the operator of gamedai. Questions go to hello@gamedai.app.

Eligibility

You must be at least 13 years old to use gamedai. If the App Store, your country, or your region requires a higher age for the app or a specific feature, that higher requirement applies.

If you use gamedai on behalf of an organization, league, creator group, or other entity, you confirm that you have authority to bind that entity, and "you" includes both you and that entity.

Accounts

You are responsible for your account. You agree to:

1. Provide accurate account information.
2. Use only one account unless we give you permission to do otherwise.
3. Keep your sign-in method secure.
4. Promptly tell us at hello@gamedai.app if you believe your account has been compromised.
5. Use gamedai only for lawful, good-faith purposes.

We may suspend or terminate an account if we believe the account is abusive, fraudulent, unsafe, unlawful, violates these Terms, interferes with the service, or creates legal or operational risk for gamedai.

Subscriptions, trials, and purchases

gamedai offers the following paid options through Apple's in-app purchase system:

1. gamedai Premium: $9.99 per month, auto-renewable, with a 7-day free trial for eligible users.
2. Lifetime unlock: $99.99 one-time purchase.

Premium renews automatically unless you cancel at least 24 hours before the end of the current trial or billing period. Your Apple ID will be charged for renewal within 24 hours before the end of the current period unless you cancel in time.

You can manage or cancel subscriptions in your Apple ID settings. Deleting the gamedai app does not cancel a subscription. Account deletion may remove your gamedai account data, but subscription cancellation is handled through Apple.

Purchases are billed by Apple, not directly by gamedai. Apple handles payment processing, taxes where applicable, payment method details, receipts, refunds, and chargebacks under Apple's policies. We do not receive your full payment-card details.

Refunds are handled under Apple's refund policies. To request a refund, use Apple's refund process.

If a price changes, Apple or gamedai will notify you as required before the change applies. If you do not agree to a price change, cancel before the new price takes effect.

We may change, add, remove, or rename plans and features over time. Any change will apply prospectively, subject to Apple's rules and applicable law.

User content and generated content

You may submit inputs to gamedai, such as questions, fantasy context, league information you connect, preferences, prompts, voice or style selections, support messages, suggestions, and other content.

You own your inputs. By submitting inputs or connecting information to gamedai, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, and use those inputs as needed to operate, provide, secure, support, improve, and debug gamedai.

gamedai may generate commentary, answers, alerts, summaries, show concepts, or other output. Subject to these Terms and applicable law, you may use output for personal, non-commercial purposes. You are responsible for evaluating output before relying on it or sharing it.

You may not submit, request, publish, or use gamedai to create content that:

1. Harasses, threatens, abuses, or targets a person or protected class.
2. Infringes another person's intellectual-property, privacy, publicity, or other rights.
3. Is defamatory, deceptive, unlawful, or intended to mislead people.
4. Contains malware, exploit instructions, spam, or attempts to compromise systems.
5. Attempts to impersonate gamedai, its staff, a league, a team, a player, or another person without permission.
6. Encourages real-money gambling, illegal wagering, fraud, violence, or other unlawful conduct.

We may remove content, restrict features, suspend accounts, or terminate accounts for violations of these rules.

If you send suggestions, feature ideas, bug reports, or other feedback, you grant us a perpetual, worldwide, royalty-free license to use that feedback without restriction or compensation.

Sports data, teams, and league references

gamedai uses sports statistics, player names, team names, game context, and fantasy-football information to describe football. These references are nominative and factual. gamedai is not affiliated with, sponsored by, or endorsed by the National Football League, any NFL team, any broadcaster, any player, or any fantasy platform unless we state that relationship in writing.

All league names, team names, player names, trademarks, logos, and related rights belong to their respective owners.

Stats, scores, fantasy data, names, and play context can be delayed, incomplete, inaccurate, misclassified, or unavailable. Do not treat gamedai as the official record of any game, league, player, roster, fantasy matchup, or wager.

Informational-only features

gamedai may include score, parlay, fantasy, lineup, player, and game-context features. These features are for information and entertainment only.

gamedai does not offer wagering, sportsbook services, casino games, real-money gambling, sweepstakes gambling, or betting execution. gamedai does not accept bets, place bets, pool money, pay gambling winnings, or connect you to place a wager.

Any parlay, score, probability, odds-like, or game-context discussion is informational only. It is not betting advice, financial advice, legal advice, or a recommendation to place or avoid a wager. If you choose to gamble elsewhere, you are solely responsible for following the laws that apply to you.

Automated and generated commentary

gamedai uses automated systems and language models to generate some commentary, answers, summaries, and reactions. Generated content may contain errors, omissions, outdated information, incorrect assumptions, or statements that sound confident but are wrong.

Do not rely on generated commentary as the only source for decisions involving money, wagering, health, safety, legal rights, employment, or any other high-stakes matter.

Acceptable use

You agree not to:

1. Use gamedai illegally or to harm another person.
2. Scrape, crawl, harvest, or bulk-download content or data except as allowed by law or our written permission.
3. Reverse engineer, decompile, bypass, or interfere with the app, site, APIs, models, security, rate limits, or access controls.
4. Use gamedai to build or train a competing product, model, dataset, or service without written permission.
5. Probe, scan, fuzz, stress test, or attack gamedai systems without written permission.
6. Use disposable, fake, or unauthorized accounts to evade limits, inflate usage, or abuse trials.
7. Upload malicious code, spam, or content that disrupts the service.
8. Misrepresent your identity or your relationship with gamedai.

We may block, rate-limit, suspend, remove, or terminate access if we believe these rules are violated.

Communications

We may send transactional messages about your account, purchases, security, support, deletion requests, and service changes. If you opt in or if applicable law permits, we may also send product updates. You can opt out of marketing-style emails through the unsubscribe path in the email or by emailing hello@gamedai.app. Transactional messages may still be sent when needed to operate your account or respond to your request.

Intellectual property

gamedai, including the app, website, code, design, brand, original content, audio treatments, product names, and service structure, is owned by us or our licensors and is protected by intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use gamedai as intended under these Terms.

You may not copy, modify, distribute, sell, sublicense, or create derivative works from gamedai except as expressly allowed by these Terms or by law.

Service changes and availability

gamedai may change over time. We may add, remove, rename, limit, suspend, or discontinue features, voices, data integrations, plans, content, or availability. We do not guarantee that any feature, data source, integration, voice, or generated output will always be available.

The service may be interrupted, delayed, unavailable, or contain errors. We do not promise a specific uptime, latency, or performance level.

Disclaimers

To the maximum extent permitted by law, gamedai is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation.

We do not warrant that sports data, fantasy data, generated commentary, Scout answers, alerts, scores, parlay-related information, or any other content will be accurate, complete, timely, or suitable for your purposes.

Nothing in these Terms limits any non-waivable consumer right that applies to you.

Limitation of liability

To the maximum extent permitted by law, gamedai and its operators, contributors, service providers, and future legal entities will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, business interruption, substitute services, or the cost of recovering data, arising out of or relating to your use of gamedai.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to gamedai is limited to the greater of one hundred US dollars ($100) or the amount you paid to gamedai through Apple for gamedai purchases in the twelve months before the claim arose.

Some jurisdictions do not allow certain exclusions or limits. In those places, the exclusions and limits apply only to the maximum extent permitted by law.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless gamedai and its operators, contributors, service providers, and future legal entities from claims, damages, liabilities, costs, and expenses arising from your misuse of gamedai, your content, your violation of these Terms, or your violation of another person's rights.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws in your location require otherwise.

Dispute resolution

Most issues can be resolved by email. Before starting a formal claim, email hello@gamedai.app with a description of the issue, what you want resolved, and how to reach you. We will try to resolve the issue in good faith.

If a dispute cannot be resolved informally, it may be brought in a court of competent jurisdiction unless a later version of these Terms adds a different dispute-resolution process that applies prospectively and is enforceable under applicable law.

Nothing in this section prevents either party from seeking urgent injunctive relief or from reporting an issue to a regulator or consumer-protection authority.

Changes to these terms

We may update these Terms from time to time. When we make a material change, we will update the effective date above and may provide additional notice in the app, on the website, or by email.

If you do not agree to updated Terms, stop using gamedai and cancel any active subscription before the next renewal. Continuing to use gamedai after updated Terms are posted means you accept the updated Terms from their effective date.
